Google plans to invest $40 billion in three new data centers in Texas by 2027.

Apple and OpenAI must face X Corp's lawsuit for now, US judge rules 

A U.S. district judge in Fort Worth, Texas, has turned down a request from Apple and OpenAI. They wanted to dismiss a lawsuit filed by Elon Musk’s X Corp and xAI. The case will now move forward.

  • X Corp says Apple and OpenAI teamed up to dominate the markets for smartphones and AI chatbots. They closely linked ChatGPT with Apple’s “Apple Intelligence” features on iPhones and other devices.

  • The lawsuit, filed in August 2025, says Apple unfairly left out competitors, such as Musk’s Grok chatbot, by:

    • “Exclusive” integration of ChatGPT into Apple Intelligence

    • Promoting on the App Store means getting ChatGPT on "Must-Have Apps" lists. This also helps to push competitors aside.

  • Apple argues that its partnership with OpenAI is not exclusive. It says there’s no deal stopping it from using other chatbots. Services like X and Grok are still available through apps and browsers.

  • OpenAI said the lawsuit is part of Musk’s broader “campaign of lawfare” and “ongoing pattern of harassment.” It looks forward to defending itself in court.
